Today, a federal appeals court is hearing arguments over whether or not to lift a Louisiana judge’s order that limited the Biden administration’s ability to urge censorship by social media companies.

On July 4, U.S. District Judge Terry Doughty ruled, in Missouri v. Biden, that the Biden White House had violated the First Amendment by urging Facebook and Twitter to censor “often-true” information about vaccine side effects, Covid’s origins and other topics.

Unfortunately, the judges may not be able to consider Public’s new reporting, which found that Facebook censored Covid vaccine information in part because it feared the impact on its $1.2 billion advertising business with Europe if it didn’t do what the White House wanted.

However, we have learned from sources close to the case that if the lawsuit goes to the U.S. Supreme Court, which many people believe it will, the justices will be able to consider the Facebook Files as evidence.

For context on that debate, I’m happy to share my interview with the University of Austin’s Hillel Ofek.
